The Israeli Committee for Combating Torture appeals to the Supreme Court for obliging the Investigation Unite to apply an accusation against a police investigator tortured a Palestinian citizen with ugly methods.
The Committee had asked the Investigation Unit for questioning the torturing policeman, but the Unit refused the order in spite of showing clear evidence against him.
The Committee had published a statement in the Israeli newspaper “Haaretz”, at the end of 2007, manifesting that (M A), a Palestinian citizen, of Ayzaie town east to Jerusalem, was arrested and taken to the police station in the settlement of Male Kadoomem.
There, the policeman beat him savagely, did bee on him and raped him with an iron bar.
The Committee added that the prisoner was taken to the medic treatment, where it was assured that he was exposed to ugly rape.
The Committee documented the violation and the testimony of the prisoner and others’ ones.
A complaint had been filled against the policeman, who was known for his violent behavior, but he has not been brought to courts up till now, added the Committee.

THREAT Mohammed Youssef

Mohammed "Habshe" Youssef is a witness of the inhuman treatment of Palestinian prisoners, ruled by the judicial system of Israel. In 2002 when the building of the wall started he was there regularly. He either just participated in non-violent demonstrations, or threw stones at the armed soldiers surrounding the on-going building of the wall. The wall was built right by his neighbourhood Aida Refugee Camp and effectively cut off the playgrounds and fields that once surrounded it.

During the night of the 25th of March 2003, the Israeli soldiers surprised his family and stormed into their house. All family members were forced to go outside the house, and stand in the pouring rain in the middle of the winter. Including children. No explanation was given during the three hours when Israeli soldiers searched their house. Mohammed and his two brothers were arrested. Mohammed was 22 and his brothers were 18 and 16.


The interrogations were going on for 40 days. He was sitting in a chair with his hands tied behind his back with his eyes covered most of the time. Other times he had his hands tied to the roof, and had to stand in that exact position for 12 hours. As written in the report, torture and violence is commonly used when conducting interrogations that are later used as valid evidence.


"Did you try to smuggle a bomb to Tel Aviv?"


"No"


A soldier hit the back of his neck.


"Are you against the wall?"


"Of course"


And again.


During these 40 days, when he was to exhausted and fell asleep water was poured over him, and the interrogations would continue. Tired and wet.


Further shortages for Human Rights in the Israeli Judicial System that Amnesty International is writing about is the lack of lawyers during interrogations, and that civilians should be tried in front of an ordinary court instead of a military court.


Mohammed got 18 years for "being a threat against the Israeli state who has to be imprisoned". But he was lucky, after one year in prison his lawyer succeeded to shorten his penalty to four years.


"My worst memory from the prison is all the diseases and injuries. An uncountable amount of prisoners were in really bad health. If someone went to the doctor with any kind of problem, anodyne was the only given cure. One man went with a really bad toothache on the right side. The doctor gave him an injection on the left side. When he complained the doctor told him to shut up and go. "Who is the doctor here?"


"Another prisoner from Aida Camp was suffering from cancer. Since he did not get any treatment in prison except of anodyne, he died just one month after his liberty."


At any time the soldiers could come in, and everybody had to stand up in the right way, fast. This was really hard, but still obligatory, for those who were in a bad health condition.



"After two years of my imprisonment my mother got help from the Red Cross to try to visit me. But the applications were denied. They said that my mother was lying, and that I was not her son. Only family members are allowed to visit."


That is why the mother of Mohammed did not meet any of the three brothers in two and a half year. The other two that were arrested the same day were also considered as guilty. One of them got three years in prison, while the other got two and a half.


After this high price for the rights of Palestinians, paid in time and pain, Mohammed is still going to the demonstrations against the wall and works for the political party Fatah. He adds though, that he is demonstrating peacefully. Nowadays he has further restrictions of movement. This is concerning all Palestinians once charged for a crime in Israel. If he is going to Ramallah, 20 kilometres away, he can envisage four hours extra at the checkpoint. And a trip to Jerusalem is impossible.


I presented the facts that the numbers of people arrested because of resistance against the wall was increasing during 2011 in comparison to 2011, the same crime as he committed in 2002. He commented with:


"Still not as many people were arrested as during 2003 – 2004. 186 persons were arrested during this time, and among them children."


And what do you think about the Palestinian future?


"I think the Palestinian future is bright. We will reach a solution for the Palestinians one day."

Administrative Detention Background

Administrative detention is a procedure that allows the Israeli military to hold prisoners indefinitely on secret evidence without charging them or allowing them to stand trial. Although administrative detention is used almost exclusively to detain Palestinians from the occupied Palestinian territory (OPT), which includes the West Bank, East Jerusalem and the Gaza Strip, Israeli citizens and foreign nationals can also be held as administrative detainees by Israel (over the years, only 9 Israeli settlers have been held in administrative detention). Israel uses three separate laws to hold individuals without trial:

* Article 285 of Military Order 1651, which is part of the military legislation applying in the West Bank;

* Internment of Unlawful Combatants Law (Unlawful Combatants Law), which has been used against residents of the Gaza Strip since 2005;
* Emergency Powers (Detentions) Law, which applies to Israeli citizens.


ADMINISTRATIVE DETENTION UNDER INTERNATIONAL LAW


Although international human rights law permits some limited use of administrative detention in emergency situations, the authorities are required to follow basic rules for detention, including a fair hearing at which the detainee can challenge the reasons for his or her detention. Moreover, to use such detention, there must be a public emergency that threatens the life of the nation, and detention can only be ordered on an individual, case-by-case basis without discrimination of any kind. (International Covenant on Civil and Political Rights, Article 9).


Administrative detention is the most extreme measure that international humanitarian law allows an occupying power to use against residents of occupied territory. As such, states are not allowed to use it in a sweeping manner. To the contrary, administrative detention may be used against protected persons in occupied territory only for “imperative reasons of security” (Fourth Geneva Convention, Art.78).


In practice, Israel routinely uses administrative detention in violation of the strict parameters established by international law. Tellingly, Israel has claimed to be under a continuous state of emergency sufficient to justify the use of administrative detention since its inception in 1948. In addition, administrative detention is frequently used – in direct contravention to international law – for collective and criminal punishment rather than for the prevention of future threat. For example, administrative detention orders are regularly issued against individuals suspected of committing an offense after an unsuccessful criminal investigation or a failure to obtain a confession in interrogation.


In practice, Israel’s administrative detention regime violates numerous other international standards as well. For example, administrative detainees from the West Bank are deported from the occupied territory and interned inside Israel, in direct violation of Fourth Geneva Convention prohibitions (Articles 49 and 76). Further, administrative detainees are often denied regular family visits in accordance with international law standards, and Israel regularly fails to separate administrative detainees from the regular prison population as required by law. Moreover, in the case of child detainees, Israel regularly fails to take into account the best interests of the child as required under international law.


ADMINISTRATIVE DETENTION IN THE WEST BANK: MILITARY ORDER 1651


In the occupied Palestinian West Bank, the Israeli army is authorized to issue administrative detention orders against Palestinian civilians on the basis of article 285 of Military Order 1651. This article empowers military commanders to detain an individual for up to six-month renewable periods if they have “reasonable grounds to presume that the security of the area or public security require the detention”. No definition of “security of the area” or “public security” is given. On or just before the expiry date, the detention order is frequently renewed; there is no explicit limit to the maximum amount of time an individual may be administratively detained, leaving room for indefinite legal detention.


Administrative detention orders are issued either at the time of arrest or at some later date and are often based on “secret information” collected by the Israeli Security Agency (formerly known as the General Security Service). In the vast majority of administrative detention cases, neither the detainee nor his lawyer is ever informed of the reasons for the detention or given access to the “secret information”.

A Palestinian detainee subjected to an administrative detention order must be brought before a military court in a closed hearing within eight days of his or her arrest, where a single military judge can uphold, shorten or cancel the detention order. In most cases, however, administrative detention orders are confirmed for the same periods as those requested by the military commander. While the detainee can appeal the decision at the judicial review, in practice, the vast majority of appeals are rejected. By comparison, administrative detention under Israeli domestic law requires a detainee to be brought before a judge within 48 hours, and orders can be given only up to three month periods.

In practice, Palestinians can be detained for months, if not years, under administrative detention orders, without ever being informed about the reasons or length of their detention. Detainees are routinely informed of the extension of their detention on the day that the former order expires. Under the existing administrative detention procedures, Palestinians have no effective means by which to challenge their administrative detention.


ADMINISTRATIVE DETENTION IN THE GAZA STRIP: UNLAWFUL COMBATANT LAW


In the Gaza Strip, Israel uses the Unlawful Combatants Law to hold Palestinians for an unlimited period of time, without effective judicial review. The law was approved by the Israeli Knesset in 2002 in order to enable the state to continue holding Lebanese “bargaining chip” detainees after the Israeli Supreme Court ruled the practice illegal. Although all Lebanese detainees were released in 2004, the law was not revoked. Instead, starting in 2005 after Israel's unilateral "disengagement" from the Gaza Strip and the accompanying end of the application of Israeli military orders there, it began to be used to detain residents of the Strip.


The law defines an “unlawful combatant” as a “person who has participated either directly or indirectly in hostile acts against the State of Israel, or is a member of a force perpetrating hostile acts against the State of Israel,” and who is not entitled to prisoner of war status under international humanitarian law.


The Unlawful Combatants Law allows for the sweeping and swift detention without trial of large numbers of foreign citizens and Palestinians resident of the Gaza Strip. To date, the law has been used to detain 54 individuals, including 15 Lebanese nationals and 39 Gazans, most of whom were detained during Israel's winter 2008-2009 military action against Gaza codenamed “Operation Cast Lead” and have since been released. As of September 2011, Israel was holding 2 Gazans under this law.


Detainees under the law may be held for 96 hours before the issuance of a permanent detention order, or up to seven days if the government declares the “existence of wide-scale hostilities”. Judicial review of an order in a closed hearing must take place within 14 days of its issuance; if it is approved, the detainee must be brought before a judge once every six months. If the court finds that his release will not harm state security, the judge shall cancel the order.


In practice, the Unlawful Combatants Law contains fewer protections for detainees than even the few that are granted under administrative detention orders in the West Bank. For example, judicial review is conducted less often; the legality of the detention does not require the existence of a state of emergency; and, the detention “is carried out pursuant to an order issued by the chief of staff or by an officer holding the rank of major general”. In addition, the law establishes two troubling presumptions that shift the burden of proof to the detainee: first, the release of an individual identified as an “unlawful combatant” will harm national security unless proven otherwise; second, the organization to which the detainee belongs carries out hostilities, if the Israeli Minister of Defense has made such a determination, unless proven otherwise. This practice patently violates the accused’s right to a presumption of innocence in any criminal proceeding, and results in a system of indefinite detention justified by mere speculation and stacked heavily against the detainee.

As is the case with so many others there are very serious, well-founded concerns that the charges brought against Khader Adnan were politically motivated.


Israeli administrative detention orders are the subject of review and further appeal by a military court, neither lawyers

nor detainees are permitted to see the “secret information” used as a basis for the detention orders.
This violates international human rights law, which permits some limited use of administrative detention in emergency situations, but requires that the authorities follow basic rules for detention, including a fair hearing at which the detainee can challenge the reasons for his or her detention.

In addition to contradicting international human rights and humanitarian law Khader Adnan's administration detention also violates article 5 (the right to liberty and security) of the European Convention on Human Rights.


It is in this context that I call on you to act and in accordance with international human rights treaties to which Israel is a signatory state, as well as the Israeli Constitution itself, is therefore obligated to undertake the following:


* . Immediately and unconditionally release Khader Adnan;


pending the conclusion of the review--and the dismissal of all charges if the convictions are found to be in violation of the above-mentioned international legal norms (the observance of which the Israel is treaty-bound to observe.)


* . Immediately put an end to its practice of administrative detention and arbitrary arrests;



* Immediately and thorough legal investigation into charges that Khader Adnan was tortured, as well as investigations into other questions of legal irregularities surrounding this case--all carried out in strict accordance with established international norms of justice.

End Isolation And Solitary Confinement !

Ahed Abu Ghoulmeh
called upon prisoners’ organisations and human rights organisations to launch
an international and legal campaign to end isolation and solitary confinement,
which he said was akin to execution.
Abu Ghoulmeh was abducted along with Ahmad Sa’adat from Jericho prison in 2006,
and is currently held in isolation.

Abu Ghoulmeh said that the Israeli prison management reneged on its promises
to the prisoners in October 2011, when it promised to end isolation in exchange
for the prisoners ending their open-ended hunger strike,
which had lasted for twenty days at that point.
The prisoners’ main demand was an end to the policy of isolation and solitary confinement; however, immediately after the strike had been ended,
the prison administration officially renewed the isolation of Sa’adat,
Hassan Salameh, and others.

Abu Ghoulmeh emphasised that this action exemplifies the complete lack of any
commitment by the government of Israel to any agreements with the prisoners,
including those stated to be included in the prisoner exchange.
For example, the occupation stated its commitment to end arbitrary punitive measures
against Palestinian prisoners that had been used during the holding of occupation soldier
Gilad Shalit as a prisoner of war; however, those measures have not only continued,
but have escalated.
Abu Ghoulmeh is in isolation in Ashqelon prison; he has been sentenced to life imprisonment
and has been denied family visits, books and newspapers.

Khalida Jarrar, member of the Political Bureau of the PFLP, also called upon
Palestinian lawyers to take up legal challenges against isolation within all courts of law,
and to take legal steps to protest this policy which is contrary to international human rights standards.
Jarrar’s statement came during a visit with the family of Abu Ghoulmeh,
including Wafa Abu Ghoulmeh, Ahed’s wife and prisoners’ rights activist, in Ramallah,
in a delegation including Bashir Khairie, Nael Khalil, Fuad Hadli, and
PA Minister of Prisoners Issa Qaraqe.

Qaraqe concurred that the policy of isolation is one of the most serious
violations of prisoners’ rights, and is a policy of slow death, as it has been termed by the prisoners.
There are currently 16 Palestinian prisoners in isolation; some have served nearly ten years.

THREAT: Medical Establishment Allowed Torture

Report
Israeli doctors failed to report abuse of prisoners and detainees.
A 61 pages report outlines various cases of alleged mistreatment including beating, threats and
sleep deprivation.
Human Rights groups suspect that the medical establishment allowed torture.

A recent report by two local human rights organizations accuses Israeli medical 

officials of failing to report injuries that suggest the mistreatment and torture of detainees 
and prisoners, in violation of professional ethics codes.
"Doctoring the Evidence, Abandoning the Victim," to be published later this month, was compiled
by the Public Committee Against Torture in Israel and Physicians for Human Rights-Israel. Based on affidavits from 100 detainees and prisoners since 2007, it states: "This report reveals significant
evidence arousing the suspicion that many doctors ignore the complaints of their patients;
allow Shin Bet security service interrogators to use torture; approve the use of forbidden inter-
rogation methods and the ill-treatment of helpless detainees; and conceal information,
thereby allowing total immunity for the torturers."



The 61-page report outlines various cases of alleged mistreatment, including beatings,
threats and sleep deprivation. It states that detainees were held for long periods of time in
stressful positions, and that they had their hands tied tightly with plastic cuffs.

The report cites "countless cases wherein individuals testified to injuries inflicted upon them
during detention or in interrogation, and yet the medical record from the hospital or the prison
service makes no mention of it."

Without such evidence, the report says, it is difficult to obtain legal redress for the alleged
mistreatment. "Effective documentation of the injury can be a decisive factor in initiating
an investigation, in bringing the perpetrators to trial and in ensuring that justice is carried out,"
the report states. A medical report should include a description and photograph of the injury,
the victim's account of events and a record of treatment, it states.

The report documents the case of a 26-year-old Palestinian, identified only as T.S.,
who was arrested in January 2009 near Ramallah. T.S. claimed he was roughed up by the
arresting officers and bitten by a police dog, according to the report. He was reportedly treated
at Jerusalem's Shaare Zedek Medical Center while blindfolded and shackled.
According to the report, his interrogators spoke with medical personnel, and T.S. said he only
realized he was at a medical facility after seeing the nurses' shoes through his blindfold.

Medical case records obtained by the Public Committee described T.S.'s dog bite and
his treatment, but not the circumstances of the injury. This is an apparent violation of international conventions, to which Israel is a signatory, obligating medical personnel to report suspicious injuries.

A complaint against the arresting officers was filed in January 2010, transferred to the
department of the Justice Ministry that investigates police misconduct, and closed about a year later
on grounds of absence of culpability.

Shaare Zedek officials said in response: "The medical documents state explicitly that he was treated
for a bite, and the doctors have no way to determine the source of the bite."

Another case involving an alleged failure to document suspicious injuries involves R.A.,
a Palestinian who claims he was assaulted by Border Police officers in the Old City of Jerusalem
during his arrest. He was brought by officers to Hadassah University Hospital, Ein Karem,
where a gash to his face was sutured.

In his affidavit, R.A. stated that he told an Arabic-speaking medical official that his injuries
were caused by police officers. The unnamed staff member indicated in his emergency room
and hospital discharge charts that the injuries were caused by a blow to the head, but
the staff member did not include any references to the circumstances.

In March, the Public Committee submitted a complaint on R.A.'s behalf to
Prof. Shlomo Mor-Yosef, director general of the Hadassah Medical Organization,
over the hospital physicians' "failure to properly document violence against R.A." and
to report the incident to authorities outside the hospital, as well as to a hospital social worker or department head, as required.

Hadassah said in a statement that it provides the best medical care to all its patients,
regardless of the circumstances of the disease or injuries. It added that because the patient
was referred by the Israel Prison Service and accompanied by Border Police officers,
"It was clear that the authorities were aware of his arrival and did not need additional notification. Unfortunately, the medical records relating to the treatment provided by Hadassah
were apparently taken by the patient or someone acting on his behalf."

The report cites evidence collected by the NGOs showing that medical personnel in some cases
allegedly prioritized the interrogation process over the needs of patients.

When physicians return detained patients to authorities - in some cases even after witnessing
the infliction of injuries - they violate their obligation to the patient, the report claims. In some cases, according to the report, investigators are given medical information on the detainee,
apparently without the patient's consent.

Ishai Menuchin, executive director of the Public Committee Against Torture in Israel,
said most abused prisoners and detainees do not submit official complaints due to their mistrust
of the Israeli justice system. "They're afraid they'll be persecuted if they complain, After all,
during their interrogation they are helpless in the hands of their interrogators, and see a doctor
only when they are hurt. We would have expected physicians to aid them and not to support the establishment, but the findings of the report belie that."

Among the report's recommendations are clear guidelines regarding the medical treatment
of prisoners, investigations of and disciplinary action against staff who violate rules,
and protection for whistle-blowers.

The Health Ministry said in a statement that it has no knowledge of medical personnel being involved
in the abuse or torture of detainees or prisoners in Israel, that medical records are kept
on these individuals and that an independent committee investigates reports of abuse.

"The Health Ministry, the IMA's ethics bureau, the prison service's medical division and the
Shin Bet have written guidelines for conduct that will be distributed to hospital staff and
administrators," the statement said.

Senior hospital physicians have told Haaretz that they were unaware of the new committee and had not received directives from the Health Ministry on the issue.
"We have an internal protocol stipulating the need to document evidence of violence.
We have a camera and document suspicious injuries for use as legal evidence," said the director of an emergency room in a hospital in central Israel. He added that there is no clear reporting protocol for prisoners, unlike for suspected abuse against women, children or the elderly.

He said the physicians ask the accompanying officers to leave them alone with the patients
when possible, for purposes of confidentiality, but admitted that it is not always possible
to do so. He also said patients' medical charts include any evidence of abuse and are not given to the accompanying officers.

Dr. Leonid Eidelman, president of the Israel Medical Association, said in response that physicians 
have a duty to report any suspicion of abuse.
The Israel Prison Service said in a statement that it provides appropriate and professional medical treatment to all prisoners and that it is subject to official oversight.
Deputy Health Ministry Director General Dr. Boaz Lev said that in July he asked the Israeli 
Association of Hospital Directors to increase awareness among physicians on the issue of detainees.

Suppression and isolation of prisoners


Administration of Naqab desert prison forced prisoners’ families, in an unprecedented step to, sign papers that prevent them from visiting their sons until next May.

Prisoners of Naqab desert prison protested on the provocations of the prison administration against them. The prisoners established a sit in, for an hour, as a step to protest on the intension of the prison administration to unloading prison and to distributing prisoners on the other departments and prisons.
Managements of both prisons of Nafha and Raymon informed prisoners that next week there will be no visits to prisoners so that the police of the prison can do the inspection of prisoners being transferred.
The process of transfer of prisoners of the Naqab Prison is the largest in the history of the Prison Service. It is said that Sunday 8, Jan will be the first day of the transfer of prisoners of the Naqab to other prisons; prisoners are distributed to Nafha, Raymond, Ofer, Eichel and Megiddo.

Your Excellency,

I am writing to express my deeply concerns about the conditions Dirar Abu Sisi is held at Ashqelon Prison Israel.
As is the case with so many others there are very serious, well-founded concerns that the treatment of
Dirar Abu Sisi is politically motivated.
The conditions of isolation to which
Dirar Abu Sisi, as well as many other Palestinian prisoners are subjected are sufficiently harsh as to have aroused international concern.

• The Fourth Geneva Convention, Article 119, clearly stipulated the illegality of the continuing isolation of the prisoner more than thirty days, regardless of the offense he made.

In addition to the needless brutality of the conditions to which
Dirar Abu Sisi is being subjected, I am concerned that the coercive nature of these conditions 

-- along with their serious psychological effects such as depression, paranoia, or hopelessness -- may undermine his ability to meaningfully cooperate. Thus, such harsh conditions are counter to
the interests of justice.
Given the nature and effects of the solitary confinement to which
Dirar Abu Sisi is being subjected, I call upon you

• to rectify the inhumane, harmful, and counterproductive treatment of
Dirar Abu Sisi immediately.
• furthermore, I call upon you to immediately take steps to fulfill the following measures:
• To immediately demand the end to the use of isolation and solitary confinement against Palestinian prisoners;
• To take effective and public action to meet the critical demands of the Palestinian prisoners on hunger strike, to respect the prisoners' dignity and human rights;
• To take effective and public action against Israel's widespread use of torture against Palestinian prisoners and detainees;
• To immediately demand that sick and injured prisoners are provided with adequate
and appropriate medical treatment;
• To pressure Israel to allow unobstructed family visits by Palestinians from the West Bank and Gaza, without glass, shackles or other obstructions;
• To pressure Israel to respect prisoners' rights to unrestricted lawyers' visits;
• To urgently increase the frequency of visits by the ICRC to Israeli prisons;
• To insist that visits by ICRC staff to Israeli prisons also include the provision of urgently needed items such as clothes, underwear, shoes, sanitary products and educational materials;
• To coordinate this work with the needs and demands of the Palestinian public, including prisoners' families and human rights organizations.
Palestinian prisoners' lives and health are at stake in their courageous effort to defend their dignity and human rights within a system that is rife with physical and psychological torture, abuse, and deprivation.

Please be assured that the international community is watching this case very closely.

THREAT: The Shawish Brothers


Khalid Jamal Shawish, 38 years of Iqaba, Tubaz,
is suffering from semi paralysis, imprisonment and isolation.
He is forced to use and struggle his daily life in a wheelchair.
This is not the only thing that Khalid is suffering from.
He has got ten sentences on lifetime and is prevented from family visits as well.
His brothers
Naser, has to face four sentences on lifetime.
Mohammad a judgment of 11 years.
Moosa, another brother, was killed due the hands of israeli occupation soldiers.
Khalid ordered many times gathering him with his brothers in one prison but in vain. 

At last the authority punished him with solitary confinement for one month, for insisting on this right.
Khalid's mother, wife and children are very worried about his condition.
The family is prevented from bringing anything to him. They stated that the prison management is preventing him from his needed medical treatment.
They became a statement of lack of interest by the israeli doctors just stating that they can't do any surgery, because it would be to dangerous for Khalid.

I am writing to urge you to immediately suspend the administrative detention order of Naim Natsche / Nabeel el-Nitshe, Hebron, Ofer Prison

As is the case with so many others there are very serious, well-founded concerns that the charges brought against Naim Natsche were politically motivated.

Israeli administrative detention orders are the subject of review and further appeal by a military court, neither lawyers
nor detainees are permitted to see the “secret information” used as a basis for the detention orders.
This violates international human rights law, which permits some limited use of administrative detention in emergency situations, but requires that the authorities follow basic rules for detention, including a fair hearing at which the detainee can challenge the reasons for his or her detention.
1 These minimum rules of due process have been clearly violated in Naim Natsche's case, leaving him without any legitimate means to defend himself.

In addition to contradicting international human rights and humanitarian law Naim Nitsche's administration detention also violates article 5 (the right to liberty and security) of the European Convention on Human Rights.

The European Parliament itself has already called on Israel “to guarantee that minimum standards on detention be respected, to bring to trial all detainees, to put an end to the use of ‘administrative detention orders’” in its resolution of 4 September 2008.

Furthermore, I would like to recall the EU and Israel’s obligations under article 2 of the EU-Israel Association Agreement, which calls for the EU-Israeli relationship to be guided by respect “for human rights and democratic principles”.

It is in this context that I call on you to act through the European Parliament to hold Israel accountable for its actions by demanding that Israel

In accordance with international human rights treaties to which Israel is a signatory state, as well as the Israeli Constitution itself,  is therefore obligated to undertake the following:

  •  . Immediately and unconditionally release Naim Natsche;
pending the conclusion of the review--and the dismissal of all charges if the convictions are found to be in violation of the above-mentioned international  legal norms (the observance of which the Israel is treaty-bound to observe.)
  • . Immediately put an end to its practice of administrative detention and arbitrary arrests;

  • Immediately and thorough legal investigation into charges that Naim Natsche was tortured and denied from needed medical treatment, as well as investigations into other questions of legal irregularities surrounding this case--all carried out in strict accordance with established international norms of justice.

Please be assured that the international community is watching this case very closely.

They renewed the adminstrative arrest for the second time against
*Sheikh Anwer Harb of Hebron for 4 months and against prisoner
*Muntaser Abu Qbaiteh, of Hebron, for 6 months.
The court of Ofer Prison have sentenced
*Dr. Adnan Abu Tebaneh, Hamas leader of Hebron, to 6 months of administrative arrest immediately after finishing his original sentence which lasted for 8 months.
The central court of occupied Jerusalem has decided postponing the trial of lawyer
*Shirin Issawi with her two brothers:
*Midhat and
*Ra’fat for the next month.
Ofer court reduced the admin arrest sentence from 6 months to 3 months for the former deputy on Fatah movement,
*Hussam Khedir, of Balata Camp in Nablus.
The Israeli Magistrate’s Court issued sentences against three citizens of Jerusalem:
*Zuhair Khedir Rajbi, sentenced one year of actual imprisonment; his brother, *Fuad, sentenced 7 months and their nephew,
*Faris, sentenced 6 months.

continues his hunger strike for more than 19 days in Jalamah interrogation center.

Prisoners of An-Naqab / Negev Desert Prison

confirmed that they are confronting with practices and savage attacks by the management including threats, suppression and torture especially after becoming the new manager. Alan Bordeh which has a history of torturing prisoners in Nafha and Ramonn Prisons.

The occupation forces prolonged, in Salem Camp, detention against some prisoners including
*Yazan Nesfat Jarar, of Jenin, for the eighth time successively,
*Fatmah Dawabsha, of Doma, Nablus; her detention is prolonged for ten days and her brother, 19 years old, for one week.

The occupation forces renewed the administrative detention against several prisoners; they are Deputies at the Palestinian Legislative Council, of the Change and Reform Bloc in Hebron,

*Khalil Rabaai and
*Muhammad Tal
for six months for.
*Nimer Yusuf Rjoub, of Hebron,
for two months and the seventh time.
They renewed detention of
*Iyad Abdullmajeed Shabaneh for six months,
*Muhanad Muhammad Siaj for four months.

"Some" other prisoners were given administrative detention

*Zakaria Nahas, human rights activist,
for six months and thedeputy of Ramallah,
*Ayman Daraghmah for six months.

*Muhammad Taha, 23, of Jerusalem,

was sentenced tofour years and additional ten thousand NIS fine for throwing stones on Zionists and injuring two of them.

Releases

The occupation authority released
*Muhammad Mansour, 42 years, of Tulkarem, after detention for eight months. *Baha Yasish, of Nablus after arresting him two weeks ago; he was detained several times before.
